An order for a new trial ought not to be granted save in exceptional circumstances. For the application to succeed, the applicant must situate themselves within Section 194 of the Seychelles Code of Civil Procedure (SCCP).

The Appellant has failed to prove that exceptional circumstances existed to justify the granting of a new trial.
